  • Features of FSSAI Central License

    As we understand it, the abbreviation for India's Food Safety and Standards Authority is FSSAI. This authority ensures that all those involved in the food industry, including those involved in the manufacture, storage, processing, distribution, sale, import and export of food, comply with certain scientifically verified regulations and principles which ensure the hygienic nature of the food product, have met the quality standards and are safe for human use. Below are the FSSAI Central Licensing features:

    India's Food Safety and Standards Authority FSSAI issues three different forms of food licences. They are:

  • If the food operator does not obtain an FSSAI certificate, they come into the charges of legal offence and are fined for negligence.
  • It is a one-time expense to obtain an FSSAI licence. The certificate is effective for 1-5 years, depending on the size and specifications of the company in question.
  • Any individual engaging in food operations such as processing, retailing, shipping, or dealing with food goods in any way must obtain a license.
  • Issuance of a license or identification certificate is regulated by the provisions of the Food Safety and Standards Regulations 2011.
  • The criteria for license or registration with FSSAI differs based on the nature and complexity of the activities of a food company.
  • FSSAI Central License:

    The Central Government issues the Central License there. When it operates in more than one territory, the FBO shall be approved for its headquarters. For FBOs such as exporters, importers, manufacturers, providers, etc., in central government facilities such as airports, seaports, etc., this central FSSAI license is required.

    FSSAI State License:

    The state government grants the state's food permit. Unless the FBO is present or conducts operations in only one state, the state government must obtain the license. The FSSAI state license must be obtained by FBOs such as small and medium-sized companies, retail stores, transporters, manufacturers, marketers, etc. The units with an annual turnover above Rs.12 lakhs are supported mainly with this.

    FSSAI Basic Registration:

    FSSAI Basic Registration is provided by the state government. These units with annual turnover under Rs.12 lakhs are granted basic registration by FSSAI. The FBOs such as small-scale manufacturers, suppliers, hauliers, distributors, retailers, etc. who are consistent with the minimum specification must be registered with the FSSAI basic registration.

  • If its a manufacturing business, then the documents are to be submitted:

  • A report on water quality research, which is used in food products. Validating portability needs to come from a recognised safety laboratory.
  • Proof whether they owned or held the property.
  • Milk supply or procurement program like milk collection centres (for the milk and milk goods processing).
  • Types of raw materials for animal production establishments.
  • A report from a well-known public health laboratory on pesticide residues of water for a unit producing drinking water, mineral water, and carbonated water;
  • If it is a transport company, then the documents that must be submitted are:

  • Certificate is given by the tourism ministry.
  • Self-declaration of the various equipment used by the activities.
  • When the business is a partnership, the documents to be submitted would be:

  • Agreement on partnership
  • Ownership affidavit or MoA about business incorporation.
  • If it is a hotel then the documents to submit are as follows:

  • Certificate given by the Ministry of Tourism (HRACC-Hotel & Restaurant Approval and Classification Committee).

    Consequences and Penalties for Non-Compliance

    Rules and laws are designed to ensure the health, protection, and proper law and order in society. Under that principle, India's central government has come up with the Food Safety Standards Act, 2011. This act aimed to simplify and bring many laws relating to the food sector under one umbrella. India's FSSAI, or Food Safety and Standards Authority, was founded to develop scientifically validated standards for food products to ensure the protection for human consumption. The Agency also controls and regulates the production, manufacturing, distribution, selling, and import of food products to ensure that customers obtain nutritious, safe food. As a result, the FSSAI Act aims to control and administer the food industry and it levies various forms of penalties on business owners for violating such regulations as part of its work.

    Any person who is registered or licensed under FSSAI must comply with the rules and regulations of the FSS Act, 2006. Food safety officers usually audit the food business operator's facility and assess the level of compliance with the legislation using a checklist. Based on the level of observance, this is marked by the food safety officer as:

  • Compliance (C)
  • Non-compliance (NC)
  • Partial compliance (PC)
  • Not applicable/Not observed (NA)
  • Premised on the above, the Food Safety Officer (FSO) may issue an improvement notice where necessary by Section 32 of the FSS Act, 2006. The officer can revoke his / her license after allowing the applicant to demonstrate cause if the business operator does not comply with the notice of improvement.

    Offences by Enterprises

    In the case of breaches, the FSSAI Act imposes such restrictions on business establishments to regulate food products and their security for human use. The fines will be levied on all companies, be they a private limited company or a limited public limited company.

  • If a business infringes under this Act, it is found guilty of the crime to all those in charge of the company who were present at the time of the offence, who were liable to the company for their business and actions, and to the company itself. So they are punished and penalized.
  • Where a company has several divisions or units in different branches of the establishment, the head of the company's department or division as appointed by the company shall be liable for food safety and shall be liable for any breach of such department or unit.
  • Penalty if a company operates without an FSSAI licence

    Where a food business owner or operator who is to acquire an FSSAI license but performs business transactions without obtaining the same shall be punishable as provided for in the Act. The person or firm found guilty of any violation can be punished with imprisonment for up to six months and/or a fine.

    Penalty if the food article is sub-standard

    If an individual or a corporation is found selling an inferior quality of the food and flouting the requirements of compliance, the same shall be penalized with a fine. The individuals or companies exempted for non-compliance under subparagraph (2 ) of section 31 of this Act shall be liable for a penalty.

    Penalty if a food item is below the specified standard

    If a person or company is found selling the poorer quality of the food and violating the compliance requirements, then it is punished with a fine. Subject to subparagraph (2 ) of section 31 of this Act, owners or businesses exempted for non-compliance are liable for a fine.

    Penalty for faulty branding

    When an individual or a company manufactures or engages in the storage, selling, distribution, or importation of misbranded food goods, a fine shall be imposed. He or she will either have to discard or take immediate action on certain food products.

    Penalty for food items containing unwanted or foreign matter

    If an individual or a company manufactures, sells, or imports food products that are found to contain foreign or alien material for human consumption, the same shall be deemed liable for a fine.

    Other penalties include:

  • Penalty for delayed FSSAI central license renewal
  • If the application documentation has not been completed within the prescribed time, a penalty of Rs.100 will be levied every day before the process FSSAI central license renewal is complete.

  • Penalty for delayed renewal of the FSSAI Registration
  • Once again, the Food Authority may collect license fees if the extension of the current license has not yet been completed within a specific time. There will be a difference between the dates of expiry and the dates of renewal. To continue the business operation, FBOs will be required to apply for a new license under FSSAI registration. After 30 days from the expiry date of the license, all food licenses shall be considered valid before the confirmation of the FSSAI central license renewal.

    History of FSSAI and recent updates

    FSSAI was established under Food Safety and Standards, 2006, which integrates numerous acts and regulations that have resolved food-related concerns in different agencies and departments. While established by the Ministry of Health & Family Welfare of the Government of India, it is regarded as an independent organization. FSSAI has been developed to set scientific standards for food products and to control their production, manufacturing, distribution, selling, and importation in order to ensure safe and healthy foods for human use.

    Any food business operator must obtain compulsory registration or license from FSSAI. FSSAI License is different from FSSAI Registration, in the sense that FBO will obtain the registration or license necessary depending on the nature and size of the company.

    Can I make changes to my license, and what is the cost of these changes?

    If you plan to make changes to your license, you can do so. A modification fee may apply if you wish to modify the information in Form C, which is equal to a one-year license fee. Certain penalties are imposed for modifications to other parts of the license.

    To surrender the license or registration, you will apply electronically by logging in the same FLRS account from which the license/registration request has been received. It shall be deemed to have been surrendered upon approval by the competent authority concerned.

    What actions do I need to perform when receiving a notice for improvement?

    Upon receiving a notice of improvement, you will act on the suggestions made by the authority concerned for improvement. The qualified authority shall arrange for a compliance report to be submitted for 14 days. If you are grieved by a notice of improvement or any decision of the authority concerned, you may appeal to the Food Safety Commissioner whose decision is final subject to the provisions to Section 32 of the Food Safety and Standards Act, 2006.

    How to renew after my license/registration expires?

    FBO may not renew its license or registration unless it is submitted before the license or registration expires. The FBO must apply for a new license or registration after the old license has expired.

    In what circumstances will my FSSAI application be refused?

    The licensing officer may reject the application if the necessary information is not provided within 30-day indicated or if he is satisfied that the application submitted is unsustainable and can not be authorized. The applicant shall be allowed to be heard before the license is refused. In this case, the grounds for refusal shall be reported in writing.
