Affidavit According to Indian Law

Even though the affidavit is regarded as proof of the facts set forth therein, courts cannot admit evidence by way of an affidavit under Indian law. Under Section 3 of the Indian Evidence Act, 1872 it is treated as evidence. It can be used for verification or as a punishment for perjury, which calls for legal action. Either the first person or third person can be used (depending on who is drafting the document).

What Does an Affidavit Contain?

  • A declaration of the truth in relation to verification, a fine, a sentence term, or a perjury penalty
  • An attested clause that certifies the affiant's (the person who is making the affidavits) oath
  • Both the author's and the witness's signatures
  • Additionally, a caption for the location and the notary public's name will be included (this serves as a reference in the court). In any legal dispute, an affidavit may be necessary as supporting material.
