An Overview

This law [Design Act 2000 and Design (Amendment) Rules 2014] and registration under it protect the unique appearance or aesthetic value of any product or creation by the creator or owner.

Design registration protects and secures the intellectual property. Our online design registration grants the owner and creator exclusive rights to their creations, which can be three-dimensional highlights such as shapes, frames, or even the layout of articles, or two-dimensional highlights such as patterns, ornaments, or adornments. If there is an infringement, the owner can seek legal assistance under the Design Act.

The registration does not protect the process of construction or the device itself, it only protects the visual or aesthetic appeal of a design. Each design is classified based on the Locarno Classification, the internationally accepted standard.

Documents Required for Design Registration in India

  • Power of attorney executed in a non-judicial stamp paper of ₹200 and duly signed by the proprietor/partner/directors of the company (Form-21 for agents and advocates otherwise GPA)
  • Four copies of the design which can be photographed, drawn or traced of the design to be registered on an A4 size paper
  • An info sheet with details of the design, proof of use and priority (for example, any previous registration or application for registration).
