The Private Security Agencies (Regulation) Act, 2005 (PSARA) is an Act of the Parliament of India that regulates the functioning of private security agencies in India. The Act was enacted to ensure that private security agencies are properly regulated and provide quality security services.

A PSARA license is required for any person or entity that wants to operate a private security agency in India. The state government issues the license in which the agency will be operating.

Eligibility Criteria for a PSARA License

  • The agency must be owned and controlled by an Indian citizen or an Indian company
  • The majority of the shareholders of the company must be Indian citizens
  • The agency must have a clean track record and must not have been convicted of any criminal offence
  • The agency must have adequate infrastructure and resources to provide security services
  • The agency must have a qualified security manager
  • The agency must have a security training institute or a training centre approved by the government.

The following are the specific eligibility criteria for the key management personnel of a PSARA-licensed agency:

  • The security manager must be a citizen of India and must have a bachelor's degree in security or a related field
  • The security manager must have at least 5 years of experience in the security industry
  • The security manager must have a valid security training certificate from a recognised institute
  • The other key management personnel must be citizens of India and must have at least three years of experience in the security industry.

Validity and renewal for PSARA License

The validity of a PSARA license is five years in most states, except Chattisgarh and Uttarakhand, where the validity extends up to 1 year only. To renew the license, a renewal application will have to be filed 45 days before the license's expiry date.

The following documents must accompany the application:

  • A copy of the existing license
  • A certificate from the police stating that the agency has not been involved in any criminal activity
  • A certificate from the fire department stating that the agency's premises are in compliance with fire safety regulations
  • A certificate from the labour department stating that the agency is in compliance with labour laws

The licensing authority will process the renewal application, and a decision will be made within 30 days. If the application is approved, the renewed license will be issued.
