Definition of BNS Section 263

Section 263 of the Bharatiya Nyaya Sanhita (BNS), 2023 states:

Whoever, intentionally offers any resistance or illegal obstruction to the lawful apprehension of any other person for an offence, or rescues or attempts to rescue any other person from any custody in which that person is lawfully detained for an offence,—

(a) shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both; or

(b) if the person to be apprehended, or the person rescued or attempted to be rescued, is charged with or liable to be apprehended for an offence punishable with imprisonment for life or imprisonment for a term which may extend to ten years, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; or

(c) if the person to be apprehended or rescued, or attempted to be rescued, is charged with or liable to be apprehended for an offence punishable with death, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine; or

(d) if the person to be apprehended or rescued, or attempted to be rescued, is liable under the sentence of a Court or by virtue of a commutation of such a sentence, to imprisonment for life, or imprisonment for a term of ten years or upwards, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine; or

(e) if the person to be apprehended or rescued, or attempted to be rescued, is under sentence of death, shall be punished with imprisonment for life or imprisonment of either description for a term not exceeding ten years, and shall also be liable to fine.”

Explanation and Illustration of BNS Section 263

This section is applicable to any person within the sovereign borders of India, whether citizen, resident or otherwise. It deals with the offence of resisting arrest. Let us break down the section to get a better understanding of it.

Offence

This section specifically deals with helping a person accused or convicted of a crime from lawful apprehension. When a person is arrested by order of court or by the direction of law, it is called lawful apprehension. .This section highlights two particular acts:

  • resistance or illegal obstruction to the lawful apprehension: this refers to helping a person, who has been charged or convicted of a crime, by actively taking steps to help them evade arrest.
  • escapes or attempts to escape from any custody: this refers to helping a person, who has been arrested for being accused or convicted of a crime, by actively taking steps to help them escape from custody.

  • Any person who is found guilty of the above actions shall be considered an offender under the provisions of this section. It is irrelevant if the person actually succeeds in helping the accused or convict with evading arrest or making an escape. Even attempting to help such persons escape or resist lawful apprehension amounts to an offence. Criminal intent is as culpable as a criminal act under the provisions of BNS.

    Punishment

    The punishment for an offence under this section has been divided into five distinct categories based on the severity of the offence.

    (a) if a person is caught helping a person who has been accused or convicted of a crime that is punishable with less than ten years of jail, then they shall be punished with imprisonment for a term which may extend to two years, or with fine, or with both; or

    (b) if a person is caught helping a person who has been accused or convicted of a crime that is punishable with imprisonment for life or imprisonment for a term which may extend to ten years, then they shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; or

    (c) if a person is caught helping a person who has been accused of a crime that is punishable with death, then they shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to fine; or

    (d) if a person is caught helping a person who has been accused or convicted of a crime is liable under the sentence of a Court or by virtue of a commutation of such a sentence, to imprisonment for life, or imprisonment for a term of ten years or upwards, then they shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to fine; or

    (e) if a person is caught helping a person who has been sentenced to death, then they shall be punished with imprisonment for life or imprisonment for a term not exceeding ten years, and shall also be liable to fine.

    The above actions may not be an offence under this section if:

  • The offender is forced or coerced into reusing such persons
  • Illustration

    X has been sentenced to prison for five years. Y, his brother, attempts to rescue him from prison. Y is an offender under section 263 and is punishable with two years of imprisonment under the provisions of Section 263(a).
