A pattern is something that is used as a model to make a copy, a design, or an expected action. For instance, the patterns that are designed on a dress are known as pattern marks. Pattern marks are the marks consisting of patterns that are capable of identifying the goods or services as originating from a particular undertaking. These patterns are distinguishing it from those of other undertakings that are registrable as trademarks.

Gives exclusive rights- The owner of the registered pattern will enjoy the exclusive right over the trademark. The owner can use the same for all products falling under the classes they have been applied for. Pattern trademark in India

Any person claiming to be the proprietor of a trademark that is used or proposed by him/her may apply for the registration of that trademark. Generally, the person who manages or examines the use of the mark, and controls the nature and condition of goods to which it is affixed, or the services for which is practised is the owner of the pattern mark.

How to register a pattern mark in India?

Step 1: Search for a good brand name

Find a good brand pattern name, by doing a quick search on a pattern name so that no one else can claim the same name pattern.

Step 2: Prepare the pattern mark application

Once the name of the pattern has been decided, enter the details in the trademark application form, which costs Rs. 350.

Step 3: Choosing the brand name registration application

There are two different ways to file the registration. One is manual filing and the other is e-filing. In the case of manual filing, the application needs to be individually submitted for registration to any one of the offices of the registrar. Whereas, in e-filing, the acknowledgment of the application is issued immediately.

Step 4: Examining the brand name and registration application

After receiving the application, the registrar verifies whether the brand name suits the law and does not conflict with other existing registered or pending brands.

Step 5: Publishing the pattern mark

After examining the pattern, the pattern or style name will be published in the Indian Trade Mark Journal. If there is no offense from another party for 90 days, from the date of publication, the brand name proceeds to acceptance.

Step 6: Insurance of the pattern mark registration

If no objection is raised, within the specified 90 days, the registrar takes the trademark application and declares a Certificate of Registration under the seal of the Trademark Registry. Once the pattern mark is accepted, it is valid for 10 years from the date of issue of the Certificate of Registration. Then after 10 years, the trademark for pattern marks can be renewed.

Documents required for filing pattern mark in India

The minimum documents and information which are required for filing a pattern mark application in India are as follows:

  • The proof for the name, address, and nationality of the applicant is needed. If the applicant is a company, the proof for country or state of incorporation with the entire address is required.
  • A list of goods, and the pattern which has been placed for which registration is required.
  • Soft copy of the pattern mark to be registered.
  • If the application is filed claiming priority from an earlier-filed application in another country, the details of that application are also required at the time of applying in India. Procedures such as application number, filing date, country, and pattern of goods and services.
  • Date of first use of the pattern in India, if used at all, or else the application can be filed on a proposed date, to be used in case the trademark is claimed before the date of the application. An affidavit attesting to such use along with supporting documents should be filed along with the application.
  • Power of attorney, a prescribed document approved by the authorized signatory of the candidate with the name and designation mentioned.

The official fee charged by the Indian trademark office is Rs.4,500 for individuals, startups and small-medium enterprises, and Rs. 9,000 for others.
Normally, a pattern mark is owned by the company that uses the mark. Usually, developing an idea for a trademark does not provide rights to that mark. In some cases, a pattern mark can be owned by one company or individual, while another company is authorized, or licensed, to use the mark.
The owner must file section 8 and section 9 declarations and make announcements between the ninth and tenth year after registration, for which a mixed form is provided. If there are no problems, the trademark can be renewed for another 10 years, and every consecutive decade, thereafter.
