  • Types of Food Licenses issued

    Central License by FSSAI - Food businesses like big-scale manufacturers, importers, etc are usually applicable for this license. In this case, the license is assigned as per the head office details that are registered with FSSAI. The business is supposed to function in more than one state, to be applicable for this license. The validity of this license ranges from 1 to 5 years.

    State License by FSSAI - Food businesses like retailers, repackers, traders, importers, distributors, etc with the annual turnover of more than Rs 12 lakhs are applicable for this license. The business must be present in not more than one state and is issued by the State Government. The validity of this license ranges from 1 to 5 years.

    Basic Registration by FSSAI - The state government issues FSSAI Registration in the state via Form A, to smaller food businesses with turnover less than Rs. 12 lakhs. The validity of this license ranges from 1 to 5 years as well.

    There are certain papers that you must arrange or obtain for the FSSAI registration process. Such FSSAI license documents are proof of the establishment of a valid food business.

    The documents required for the FSSAI food license registration process are as follows:

  • As the owner, you would be required to submit proof of identity, such as Aadhaar card, driver's license, voter ID card, etc.

  • A food safety management plan form must be obtained and annexed. In the lack of one, the FBO can obtain it by contacting the closest notary or simply printing the online document.
  • The proof of possession of that business premise should be affixed along with the other documents. The proof of the business place can be provided for the startup by showing a sales document, rent agreement, power bills, and others like these.
  • The paper one needs to submit is the national occupational classification or a NOC issued by the regional corporation or any other local authority.
  • If one has a high-end updated kitchen, then one can display a kitchen floor layout. It doesn't extend to the smaller kitchens and small companies. If one has multiple business partners running the food stall or business, then one should present the partnership deed.
  • If the company operates on any other premise, then the FSSAI registration form can also be attached to an Affidavit of Proprietorship.
  • Every cooking and food business has its unique selling feature. So, make sure there's an attachment of the food category list with the other documentation.
  • Also, a list of the various types of heavy kitchenware (if any) should be presented. Especially when the food business is one that focuses on large-scale producing or manufacturing.
  • Finally, to ensure hygiene and quality controls, health certificates of all employees and stakeholders must be provided.
  • Perhaps not all documents for the different types of food businesses will be readily available. Smaller startups do not need some of the above-mentioned documents. But it's vitally important to provide all the documents you can obtain for registration of the FSSAI certificate.   • Consequences and Penalties for Non-Compliance

    There are two main types of penalties FSSAI imposes on the food businesses.

    FSSAI License Delayed Renewal Penalty

    If the application documentation has not been completed within the given period, a penalty of Rs.100 will be imposed per day until the FSSAI license renewal process is completed. An FSSAI online application is also available to make the overall process easier for the FBOs.

    Delayed FSSAI Registration Penalty

    The food authority will again request licensing fees if the renewal of the current license has still not been done within the agreed period. A gap between the expiry date and the renewal date is considered. The business operators will be expected to apply for a new license to continue the business operation under FSSAI registration. The registration is considered valid until FSSAI renewal confirmation after 30 days from the license's expiry date. There is also an FSSAI online application for renewal made available in the FSSAI portal.

    Any FSSAI registered person shall follow the rules and guidelines issued in the Food Safety and Standards Act, 2006. The Food Safety Officer normally performs an inspection of the food business operator 's facility and identifies the level of accordance with the regulations using a checklist. Based on the level of compliance, the food safety officer defines it as:

  • Compliance (C)
  • Non-compliance (NC)
  • Partial compliance (PC)
  • Not applicable/Not observed (NA)
  • Based on the foregoing, a notice of improvement may be issued by the Food Safety Officer, if required under Section 32 of the FSS Act, 2006. If the business owner fails to comply with notice for improvement, the license may be cancelled by the officer after the licensee was already allowed to display causes. Any food business owner directly impacted by such notice of improvement shall appeal to the Food Safety Commissioner of the state. The decision may even be questioned by appealing to the Food Safety Appeals Tribunal / High Court of Justice.

    The FSSAI registration procedure and the renewal process are all keenly monitored by the FSSAI authorities. Hence FBOs conducting any offence during the FSSAI registration procedure will be readily notified and be penalised by the authorities.

    History of FSSAI and recent updates

    The Food Safety and Standards Authority of India (FSSAI) is the Food Corporation of India, established in August 2011 according to the Food Safety and Standards 2006 provisions. Although it was established by the Ministry of Health & Family Welfare, Government of India, FSSAI is considered to be an independent organization.

    In all Indian states, the Indian Food Safety and Standards Authority has a regulatory body to license all food companies in that state. As a result, every food business operator in a state is granted an FSSAI license or a basic registration through the FSSAI regulatory body of that particular state. Food business operators may be food producers, brokers, food owners, etc. They need to receive a 14-digit license number or enrollment number, which is then printed on the food packages.

    There have been various updates to the FSSAI regulations taken place since its commencement. The following are the latest updates:

  • In February 2020, it was confirmed that FSSAI has set specific criteria for the country 's large packaged sweets market. It is a move that would see the manufacturers and suppliers of such packaged foods lessen the use of sugar, fat, salt and ensure proper use of raw materials in their food items.
  • FSSAI has launched an online training program in May 2020, to tackle the challenges of ensuring an undisturbed food supply whilst also sustaining the chances of acquiring SARS-COV-2. It is known for causing coronavirus (Covid-19) disease. This is intended to safeguard people like workers, customers, and many others in the chain. Online training is launched in the frame of reference to FSSAI 's Flagship Operation, Food Safety Training and Certification Program (FoSTaC), through its various authorized training partners.

    How to renew your FSSAI registration after expiry?

    My Registration is suspended. How can I revoke the suspension?

    The ground for suspension is set out in the Notice of Improvement issued to the Food Business Operator (FBO). FBO shall take corrective actions as set out in the Notice of Improvement and inform the licensing office

    The Licensing Authority may revoke the suspension with or without an inspection if it is satisfied with the FBO measures taken. The FBO may also bring an appeal against the FSS Act, 2006, empty Improvement Notice Section 32(4).

    What is the difference between registration and licensing with FSSAI?

    Registration of FSSAI is a vital registration for small business owners. Whereas, FSSAI food license is basically of two types: central and state licenses. These licenses are for food producers and FBO, which are expanded throughout the respective state and country. FBOs are primarily food importers and exporters.

    Will there be one or different licenses for the same premises if the same FBO produces different products?

    Various licenses may be issued under FSSA, as each product's criteria is different. But in the same location, if a license is obtained to process meat, milk & vegetables or fruits, a separate license must be given, as this will be performed in separate portions and businesses are not related. However, if it is accompanied by fruit & vegetable processing & store, since they are connected activities, only one license applies.

    What are the standards/regulations changing procedure?

    • The new rules/regulations are to be done repeatedly now and then in the FSSAI. The rules or regulations shall be submitted to the Scientific Panels and Committee for their viewpoints or suggestions.
    • The regulation shall be confirmed by the food authority and the draft notified to the central government after prior approval.
    • A period of 60 days is normally specified for the information of persons likely to be affected by it and for comments to be forwarded to FSSAI.
    • The comments obtained about the draft notification shall be considered by FSSAI. The draft standards or regulations are received in case of divergent comments.
    • The final notification is submitted in the Gazette of India giving the schedule of its execution.

    What are the registration criteria?

    • Registration is provided to the petty FBOs whose annual turnover doesn't exceed Rs. 12 lakhs.
    • Registration shall be granted by the registering authority which may be any of the following: A Designated Food Safety Officer or any official in the panchayat, municipal corporation, or any other local body that is authorised by the State Commissioner for Food Safety.

    What are the types of food licensing?

    There are 3 FSSAI food license types:-

    • Basic registration: For a business with a turnover of under 12 lakhs. Small restaurants and food sellers usually use this license as this is only a license and not a registration.
    • State license: For a company with a turnover of over 12 lakhs and under 20 crores. Small and medium-sized FBOs typically use this license. You will also have to take a central license if you have an office in more than one state.
    • Central license: For a business with a turnover exceeding 20 crores. This license is usually issued to large FBOs. As the manufacturing company must comply with Schedule 4 of the FSSAI. And if you're doing an e-commerce business online then a central e-commerce license is also mandatory. This e-commerce license is obtained regardless of their turnover.

    What is the validity period for food licenses in India?
