Introduction 

Land conversion is the process of converting agricultural land into other non-agricultural. Except for diversion into non-agricultural, agricultural land cannot be used for commercial or residential purposes. According to the Madhya Pradesh Land Revenue Code Amendment Act 2011, agricultural land may only be used for non-agriculture purposes if the appropriate authorities have granted permission. Madhya Pradesh Land Revenue Code Act

Madhya Pradesh Government introduced Madhya Pradesh Land Revenue Code (Amendment), Act in 1959. Madhya Pradesh Land Revenue Code Amendment Act, 2011 regulates the conversion of agricultural land to non-agriculture in Madhya Pradesh. All land is to be considered irrigated agricultural land for the purposes of the Madhya Pradesh Land Revenue Code.

Madhya Pradesh Ceiling on Agricultural Holdings Ordinance

Madhya Pradesh Ceiling on Agricultural Holdings Amendment Ordinance, 2015 requires that a buyer informs the relevant authority (District Collector), within 90 days of the date of acquisition, that he intends to convert his land for non-agricultural purposes. The buyer must convert the land within one year of purchase and begin the proposed non-agricultural use within three years

Exempted Land

 The following land types are exempted from conversion according to the provisions of this Code:

  • Lands owned by a local authority, or a University in Madhya Pradesh
  • Madhya Pradesh Agro Industries Development Corporation Ltd holds land
  • If the State or Central Government manages the corporation, the land of the corporation cannot be transformed
  • The land that is owned by the public trust cannot be converted. According to the Madhya Pradesh Code Act.
  •  Conversion is not permitted on land used for religious purposes.
  • Land owned by the Madhya Pradesh BhoodanYagnaAdhiniyam in 1968. A co-operative land bank, registered or under the Madhya Pradesh Co-operative Societies Act, holds the land.
  • A bank company may hold land as defined by section 5 of the 1949 Banking Regulation Act.

Landowners who plan to convert agricultural land for non-agriculture uses are liable for tax.

No premium will be charged if a land that was originally assessed for non-agricultural purposes is converted into agricultural use.

Madhya Pradesh, Land Revenue Code Act states that no premium will apply to the conversion of land for charitable purposes, such as orphanages, working women’s hostels, orphanages, and hostels for mentally or physically challenged, orphanage homes, or developing sports facilities.

The rate of premium for various purposes are below:

Madhya Pradesh Land Conversion Method

Below is a detailed explanation of the procedure for converting land use in Madhya Pradesh. People who are older must apply directly to the District Collector’s office with a completed application form and all supporting documents.

The amendment to the MP Land Revenue Code act now allows land not shown on the master plan to be converted online. Online payment allows the landowner to calculate and deposit the fees. The certificate of land conversion will be issued to the fee receipt.

Step 1 – Go back to the home page of Jabalpur.

Step 2 – Click the Land Diversion option from your home page. The link will redirect you to the new page. 

Step 3 – Select the village from the drop-down menu, and then click on choose.

Step 4 – Provide the following information on the new webpage.

  • Number of Measles
  • Street number
  • Plot Number
  • Name of the Holder

Step 5- Once you have completed all information, click the Account Holder Details button.

Step 6 – Land diversion application will be displayed. Please provide the following details: Landowner name, extract details (7/12), the purpose of land conversion, etc.

Step 7- The online premium rate is calculated based on the agricultural land’s market value. 

After the premium has been paid, the fee receipt for the land diversion will display after the request has been approved by the District Collector. This receipt can be used to obtain a certificate for land diversion. The fee receipt will be used by the landowner to divert agricultural land for non-agriculture uses such as residential, industrial, and commercial.

Deviated Land Assessment

 If land that has been used for non-agricultural purposes is re-assessed and then re-assessed, the new assessment will equal the agricultural assessment of the land at the last settlement.

If land that was already used for non-agricultural purposes and has been assessed on that basis is reverted to agricultural use, the assessment of re-diversion shall be made at the rate applicable to that village or the neighboring village at the previous settlement.

If land that was originally assessed for one purpose is used for another, the assessment will need to be revised, and land revenue will be set at the rates for re-assessing.

The assessment will be based on how much land is used for non-agricultural purposes. The following rates are used to re-assess land revenue:
