What is EC?

A legal document known as an Encumbrance Certificate (EC) demonstrates that your property is free of all debts, both financial and legal. A certificate of encumbrance serves as proof of ownership or a free title. It formally establishes that a property has a clear title and can be sold with no outstanding legal disputes or claims. Different states have different procedures for obtaining an Encumbrance certificate. Get all the details on Land Registration Process Online!

Importance of The Encumbrance Certificate

The following points illustrate the importance of an EC:

  • Customers should look for any encumbrances because purchasing a home requires significant financial investment and because they could pass them along with the property owner.
  • A buyer is given assurance that a property does not currently have any financial or non-financial liabilities, such as liens, unpaid loans, and leases, by obtaining an “Encumbrance Certificate” for it.
  • Customers should obtain the document since it is also given at the time of loan against property and home loan applications in order to secure the legal name of the property as well as to ensure that the buyer is qualified for the loan.
  • The following scenarios are likely to necessitate the Encumbrance Certificate
  • The documents are submitted to complete the property mutation (Khata Registration, Khata Transfer, and Patta).
  • The Village/Panchayat Officer receives the certificates to replace the land tax records if the required property or land tax is not paid for more than three years.
  • To withdraw PF for purchase, construction, or real estate

Processing fee

An Encumbrance Certificate is issued only after collecting all the necessary information. If the property is less than or equal to 30 years, the fee would be Rs 200. If it is more than 30 years, the fee would be 500.
