  • Examining the Trademark Registry’s Application

The Applicant, through their Attorney, shall legally reply to any objections raised within 30 days of the date of examination.

The Indian Trademark Journal must be published if the Trademark is approved for registration. This aspect is the most crucial phase in the registration of a trademark. Rival brands should file no opposition within four months (120 days).

  • Register Certificate <H3>

If there is no opposition within 120 days, the Registrar must register a trademark application. The Trademark Registry seal is attached to the Registration Certificate issued by the Registrar. Once you have received your certificate, you can use the registered trademark logo or next to your brand name. The certificate is valid for 10 years and can be renewed every 10 years.

  • Trademark Search

  • Trademark Application

A Trademark application will usually be examined within one month of the filing date. A Trademark Examiner examines Trademark applications under both absolute and relative grounds of objection under Section 9&11 of the Trademarks Act 1999. An Examiner can either accept or object to the application under Section 9 and 11.

  • Response to the Examination Report

If the Examiner objects to a Trademark application under Section 9 or both, it must reply to the examination report within a stipulated period of 30 days. The application will be discarded if not replied to in the prescribed time. Therefore, a detailed reply to the examination report is recommended with strong averments and supporting pieces of evidence.

  • Auditory

The examination report’s reply may not convince the Examiner. If that happens, a hearing will most likely be scheduled. A hearing is not subject to a time limit, but the Applicant and their agent must attend when it is scheduled. The Examiner will accept or reject the Trademark based on the evidence provided at a hearing.

  • Advertisement in an Official Journal about a Trademark

After a mark has been accepted or permitted by the Examiner at the examination, or after hearing it, it is published in an official journal. Advertisement serves the purpose of communicating to the public that a mark is soon registered. If anyone has any problems with registration, they can file Opposition within four months of the publication date.

  • Certificate of Trademark Registration

A Trademark is granted if there is no opposition within the four months of advertisement. A mark can be registered for 10 years starting from the date it was filed. You can renew your registration during the last year by paying the appropriate fees.
