If the Examiner objects to a Trademark application under Section 9 or both, it must reply to the examination report within a stipulated period of 30 days. The application will be discarded if not replied to in the prescribed time. Therefore, a detailed reply to the examination report is recommended with strong averments and supporting pieces of evidence.

  • Auditory

The examination report’s reply may not convince the Examiner. If that happens, a hearing will most likely be scheduled. A hearing is not subject to a time limit, but the Applicant and their agent must attend when it is scheduled. The Examiner will accept or reject the Trademark based on the evidence provided at a hearing.

  • Advertisement in an Official Journal About a Trademark

After a mark has been accepted or permitted by the Examiner at the examination, or after hearing it, it is published in an official journal. Advertisement serves the purpose of communicating to the public that a mark is soon registered. If anyone has any problems with registration, they can file Opposition within four months of the publication date.

  • Certificate of Trademark Registration

A Trademark is granted if there is no opposition within the four months of advertisement. A mark can be registered for 10 years starting from the date it was filed. You can renew your registration during the last year by paying the appropriate fees.
