Supreme Court Judgement on Cancellation of Gift Deed

(2022), the Supreme Court Judgement held that Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 would be attracted only if the transfer of property by a senior citizen was subject to a condition of providing the basic amenities and basic physical needs to him/her. The Court further held that the mere fact that the donee has not fulfilled the expectations of the donor after the gift was made is not a ground for cancellation of the gift deed.

In the case of B.S. Joshi v. Sushilaben (2013), the Supreme Court Judgement held that a gift deed cannot be cancelled simply because the donor has made a new will bequeathing the same property to someone else. The Court held that the will would have effect only after the death of the donor, and therefore, the gift deed executed earlier would remain valid.
