Does a Work Need to Be Registered to Claim Copyright?

Several companies wonder if they need to register a copyright in their content to be able to claim a copyright for their content. Find out if registering your copyright is necessary for this blog.

A copyright is defined as an intellectual property that enables the owner to have exclusive control over copies of their creative works. Additionally, it is also defined as the owner’s rights over the creative work that the owner has developed. In India, Claim copyright law comes under the copyright act of 1957, and it entitles the owner to the right to produce, distribute, and display the work in public.

According to the Act, an owner is permitted to create a book, a song, or a painting. The Act enables the owner to do so. However, if you have claimed the remuneration for the forgery of your work, you must opt for copyright registration. We will learn in detail how to register a work to claim copyright.

What Are the Procedures for Obtaining Copyright Registration?

There are different ways to obtain the copyright registration of your creative work. But before we dive into the same. Let us learn what the benefits of having a copyright are:

The Owner Gets the Public Ownership of Their Creative Work.

Copyright helps the owner get their work into the public domain without losing their rights. In the case of works that belong to their rightful owners, their originality cannot be questioned. No one can claim they were unaware of the owner and his work. Everyone will know that no one else can do the work when the work is in public.

Presumption of the Ownership

The owner can presume ownership when creative work is registered within five years of publication. A presumption of ownership is also crucial to preventing infringements of the work or severe misuse of it. Furthermore, if copyright registration is done within five years, nobody other than the owner can claim ownership.

Owners Can File a Lawsuit Against Copyright Infringement.

If the owner finds their work misused, they can file a lawsuit under section 48 of the Copyright act. Further, by opting for copyright registration, the owner can claim his rights to the work. If the owners have the copyright, then the owners can file a lawsuit against the people for copyright infringement.

Thus, these are the benefits of having a copyright for your work. Now, how to get a Legal Copyright Registration of your work is as follows:

File for Form 16 Application

The owner has to file form 16 of the copyright act of 1957. They can go to the copyright office or file the e-application online through the official website http//www.copyright.gov.in. An application fee of ₹ 500 should be paid.

Attest the Application and Ensure That the Advocate Countersigns It.

Secondly, sign the application and countersign it through your advocate to ensure that they are authentic and legal. Further, this will ensure that your application is considered a top priority. The countersign by the lawyer gives the copyright application legal validity before the eyes of the law.

The owner will get a diary number, and they have to wait for the examination process to be complete.

Thirdly, the judiciary examines the application, and the owner gets a diary number of the same. Further, they must wait for the entire process to be completed and approved. The owner has to wait 30 days for approval.

If There Is No Objection, Then the Registration Process Is Complete.
