What is the Real Estate Regulation and Development Act (RERA)?

According to the provisions of the RERA Act, the following individuals are required to register the real estate project with authority in the state of Maharashtra:

  • Any person who constructs or wishes to construct an independent building or a building consisting of apartments or modifies an existing structure into apartments.
  • Any person who develops land into a project to sell it to others.
  • Any plots owned by the development authority are for sale.
  • A cooperative housing finance society at the state level and a primitive cooperative housing society that constructs apartments or buildings for members or allottees.
  • Any person who acts as a builder, coloniser, contractor, developer, estate developer, or by any other name, or claims to be acting on behalf of the landowner of the property on which the building or apartment is built or plot is developed for sale.

Documents Required For The Rera Registration

Documents Required For Promoters

  • PAN Card
  • A printout of the legal title report.
  • Verified copy of encumbrance specifics.
  • A printout of the layout approval as well as the building plan approval.
  • Proforma of the allotment letter and sale agreement signed
  • Form B Declaration
  • Certificates from the architect (Form 1 – required only for ongoing projects).
  • Architect’s certifications (Form 4).
  • Certificates issued by the CA (Form 3).
  • Certificates issued by the CA (Form 5).
  • Certificates from the Engineer (Form 2 – only required for ongoing projects).
  • Certificates of graduation

Documents Required For An Agent

Submit these documents as an Agent:

  • PAN Card.
  • Registration particulars, including bye-laws
  • Association memorandum
  • Articles of incorporation
  • All letterheads must be self-certified.

  • The real estate agent is advised to use acknowledgment receipts.
  • Income tax returns for the previous three years in the form of declaration
  • No pending criminal or civil cases.

The promoter and Agent shall also provide or produce any additional documents requested by the relevant authority.

Fee for RERA Registration

To complete their RERA Registration, promoters shall pay a registration fee to the Maharashtra RERA: https://maharerait.mahaonline.gov.in/ authority under RERA Act 2016. Payment can be made via RTGS or NEFT transactions. Each square metre costs Rs.10 to register. And the registration fee for the project can range between Rs.50,000 and Rs.1 lakh. Process of RERA Registration under RERA in Maharashtra

Step 1: First, you should visit the official website of Maharashtra RERA.

Step 2:  To create a new user ID, click on “New Registration”.

Step 3: The link will expand, and a new webpage will open, select the “User Type” (Promote/Real Estate/Citizen).

Step 4:  Submit all the asked details based on your prior user type selection.

Step 5: Once your email ID has been verified, login into your created account.

Step 6: Select ‘Individual’ or ‘Other than Individual’ as the information type and fill in the relevant details before clicking save the profile to save your profile for convenience.

Step 7: After filling out the form, upload a photo, and proceed with selecting the click on add new member option to save the documentation.

Step 8: If the promoter has started projects in the last five years, the promoter should also fill out the experience details. 

Step 9: After you’ve concluded the form, click the Save Experience button.

Step 10: To add project details, click “Add Project.” Fill out the form with the necessary information and save it.

Step 11: If this is a new project, click “New Project” and enter the necessary information. After completing the application, click “Add project” to save it.

Step 12: Select the “Add Building” button to add building details and common areas and facilities provided by the promoter, and then enter the total cost required for project development.

Step 13: Following the upload of the document, the promoter must enter the following information: professional project details, litigations related to the project, activity details, and click the “Save” button.

Procedure to File a Complaint in MahaRERA

MahaRERA implemented a simple yet effective complaint registration procedure to provide maximum customer convenience. The main goal was to provide a legitimate way for homebuyers to report fraudulent activity. Follow the steps outlined above to easily file an RERA complaint against the promoter, builder, or Agent.

Step 1: To begin, go to the online portal and select the ‘New Registration’ tab to access the complaint forum.

Step 2: To proceed with the process, change the ‘User Type’ to ‘Complainant’ next to this. Submit the necessary information. After completing the user registration, log in to the system using the credentials.

Step 3: Select the ‘My Profile’ tab from the ‘Accounts’ dropdown menu. Submit the requested information.

Step 4: Select the ‘Complaint Details’ tab and then the ‘Add New Complaints’ tab.

Step 5: The new complaint section includes your complaint and all relevant information such as the division, RERA number of the agent or builder, RERA project name, and agent name. The promoter’s name appears on the screen automatically.

Step 6: Enter additional complaint information such as name, project type, interest paid, and complaint address.

Step 7: Fill in the respondent’s name, type, and address.

Step 8: Following that, upload scanned copies of the documents mentioned in support of the filed complaints and reliefs sought.

Step 9: After submitting a complaint, pay the applicable fees for the complaint’s final registration.
