There are two ways to get a marriage certificate in UP; online and offline. In this blog, we will talk about both in detail.
A marriage certificate is an official document. Marriages are registered in India according to The Hindu Marriage Act of 1955 and the Special Marriage Act of 1954. A marriage certificate is a validation that a couple is legally married.
The Supreme Court of India made it a compulsion to register a marriage for women’s protection in 2006. Thus, the court has ensured that marriage registration is for its legal benefits. Marriage can happen between two individuals regardless of color, caste, or creed in a country. Weddings can be intra-communal as well.
Reasons for Marriage Certificate
A marriage certificate is a vital requirement for applying for a passport or bank account in India. This is mainly needed post-marriage as the report will be based on the husband’s surname. A marriage certificate is also needed for visa applications for foreign trips or shifts abroad. A marriage certificate is the only legal proof of your marriage according to the law of India.
Marriage Registration – Types
There are two Acts under which marriages in India are registered:
- The Hindu Marriage Act of 1955, and
- The Special Marriage Act of 1954
The following conditions must be followed for marriage in India:
- The Male candidate’s age must be 21 years, and the female candidate’s age must be 18 years;
- Both Male and Female candidates should not have a spouse at the time of applying for marriage;
- Any kind of mental disability/disorder for any candidate should not be considered a reason for marriage. With such unfit characteristics, the marriage can be violated by any of the candidates;
- Both the candidates should have a relationship under The Hindu Marriage Act of 1955 until and unless the governing authority takes responsibility for such a marriage;
- The candidates should not be in any blood or biological relation to each other until and unless the governing authority allows such a marriage.
Marriage Registration – Procedures
Two types of procedures are followed in India: Offline and Online – https://services.india.gov.in/service/
Offline Registration
To register offline, the following are the procedures to be checked:
- The form must be carefully filled up and duly signed by the couples and submitted in the mentioned section of the office with valid documents required for registration. Eligibility criteria should be taken care of;
- Payments are to be made at the registrar’s office for further application form procedure. The precedence of the form is done within the campus of the office;
- Both the candidates will then be summoned to the SRO to take the next step of the procedure;
- On the date given by the registrar’s office, both the candidates have to be available along with the mentioned eye witness for validation of the marriage certification process;
- The couple will then have to sign in the presence of the registrar and take oaths to carry the marriage forward permanently; and
- Lastly, both the candidates can take their marriage registration certificate from the registrar’s office on the same day of marriage.
Online Registration
Marriage registration online are comparatively easier, especially if the couple is busy doing it in person. The UP Government has put an online system for registering a marriage into effect. The procedure includes:
- Register on the website. The government website is where the process can be done as per the need of the couple;
- Valid documents must be scanned and uploaded on the website page under the required documents section;
- Different kinds of application forms are available on the website, and the selection of the correct application form is compulsory for the couple to register themselves in the government column;
- The male and the female candidate have to carefully fill up their part of the application without any error, or else there is a chance of the rejection of the form in the first place;
- Before final submission of the form, candidates can look in the preview section to go through the completed form;
- The website page will demand a particular user id and password so that the candidates can later check the status of their application form;
- After signing in to the portal, the steps are easy and can be done without any hassle;
- An acknowledgment slip is generated against filling up the registration form, and the slip has to be kept under notice to claim the marriage certificate from the portal.
- A visit to the SRO office is a process added here to complete the physical presence of the candidates for the validation of the marriage under The Hindu Marriage Act of 1955.
Documents Required
Some valid documents are essential when applying for a marriage registration certificate. They are
- Application form of the candidates;
- Duly signed application forms from both the male and the female candidates;
- Residence proof certificates and documents to be presented like Aadhaar card, ration card, bank details, etc.;
- Present passport size photographs;
- Photographs of the bride and groom at the time of their social marriage for more clearance;
- Affidavits provided from both the candidates;
- Birth certificates as valid age proof or else education certificate to calculate the correct age of the candidates;
- Aadhaar Card;
- Invitation card during social marriage as proof;
- Witnesses to validate the social marriage and at the time of signing the certificate in the presence of the registrar;
- Separate affidavits from both the candidates to prove the conduct of marriage is free from any social and political pressure or life threats from any source under the judicial law of the country.
