Designs Registration under Designs Act

1. It must be new or original, not previously published or used in any country. 2. It must relate to the shape, configuration, pattern, or ornamentation that is applied or applies to an article. 3. Design plans, layouts, and manufacturing processes are not eligible for registration under the Act.

Law Applicable for Design Registration

1. The Designs Act, 2000 and the corresponding Designs Rules, 2001, which came into effect on 11 May  2001, are responsible for the registration and protection of industrial designs in India.  2. The Design rules of 2001 were amended by the Design (Amendment) Rules 2008 and the Design (Amendment) Rules 2014.
