What are the new rules for food businesses during the pandemic according to FSSAI?

Amid the pandemic, FSSAI has introduced new regulations for food businesses. These rules encompass safety protocols, hygiene standards, and compliance measures to ensure the well-being of both consumers and the industry.

Did you know that due to food poisoning cases, the Kerala government has banned egg-based mayonnaise in hotels and restaurants? They’ve also introduced quality control measures, like requiring production and best-before dates on food packages and planning to launch a hygiene rating app. State Health Minister Veena George discussed these changes with hotel, bakery, and caterers’ associations before implementing them.

Introduction: New Rules for Food Businesses During the Pandemic

The COVID-19 pandemic has brought about significant changes in various sectors, including the food industry. In response to these challenges, the Food Safety and Standards Authority of India (FSSAI) has introduced new rules and guidelines for food businesses. These measures prioritise public safety, minimise health risks, and ensure the smooth operation of food establishments during these trying times.

Ease of Doing Business in the Food Industry After the Pandemic

The pandemic has disrupted various aspects of the food industry. However, in adapting to the new normal, several measures have been implemented to facilitate ease of doing business in this sector.

Commencing Food Business Temporarily with Permission: Recognising the challenges faced by food businesses, temporary measures have been introduced to allow businesses to begin operations with temporary permissions while working towards obtaining the necessary licenses and permits.

E-Inspection for Processing Applications: In 2020, FSSAI and other regulatory bodies introduced e-inspection, streamlining the licensing application process. This approach eliminates the need for physical inspections and paperwork, allowing businesses to submit applications online, undergo virtual inspections, and receive licenses promptly.

Extension of Validity Period for License Renewal: To ease the burden on food businesses affected by the pandemic, authorities extended the validity period for licenses due for renewal. This extension provided relief by granting businesses more time to comply with regulatory requirements and maintain continuity in their operations.

Food Testing and Import Clearance as Essential Services – FSSAI rules for food businesses

During times of crises such as the pandemic, the Food Safety and Standards Authority of India (FSSAI) has acknowledged the critical role played by food testing and import clearance services. Food testing involves assessing the safety and quality of food products, and ensuring they meet regulatory standards. Import clearance, on the other hand, involves inspecting and permitting the entry of food items into the country, and verifying their compliance with safety and quality criteria.

FSSAI has classified food testing and import clearance for food items as essential services. This designation ensures that FSSAI’s accredited public and private laboratories can continue their operations without disruption. It guarantees that food samples are promptly tested for safety and compliance and that imported food products meet the necessary standards, ultimately safeguarding public health and maintaining the integrity of the food supply chain, even during challenging times.

Inspections During the Pandemic

Routine inspections, with the exception of high-risk products like milk and meat, have been put on hold during the pandemic. However, e-inspections will continue to ensure compliance with food safety standards.

FSSAI has also urged state authorities to ensure the uninterrupted supply of food and to prevent regulatory compliance requirements from hindering food business operations.

Ease of Operation for New Businesses Opening During the Pandemic

FSSAI has provided an exception for new food business operators during the pandemic. They are allowed to temporarily operate if they have received a valid receipt for an FSSAI license or have a successful registration application. It’s important to note that this is an interim relief measure, and businesses must secure their final licenses or registrations.

Ease of Operation for Manufacturers During the Pandemic

Manufacturers are permitted to increase their capacity during the pandemic, provided they have a valid receipt for an FSSAI license or registration application.

Extension of Deadline for Filing Returns and License Renewal

Extension of the Deadline for Submitting Annual Returns for FY 2022-23 – regarding this matter, the Food Authority has approved an extension of the deadline for submitting the Annual Return [as specified in Condition of License number 5] until June 30, 2023.

Documents Required for FSSAI License

To obtain an FSSAI license, businesses must submit specific documents depending on their category. For instance, hotels and food processing units require different sets of documents, including proof of identity, premises, and compliance with safety standards.

Consequences of Not Renewing Your FSSAI License – FSSAI Rules for Food Business

Failure to renew an FSSAI license within the specified time may result in a daily penalty of ₹100. An expired license cannot be renewed, and businesses will need to file a fresh application. Moreover, operating a food business without the required license can lead to penalties, including imprisonment and fines.

In conclusion, the FSSAI has introduced a range of measures and modifications to ensure the smooth functioning of food businesses during the pandemic. These measures not only prioritize public safety but also streamline the licensing process and provide temporary relief to new and existing businesses. Staying compliant with these regulations is crucial to avoid penalties and maintain the integrity of your food business.
