NOTICE returnable on 20/4/2015, on condition that the petitioner shall deposit the amount in dispute, which is disclosed in the recovery certificate at page 30 i.e. Rs.4,49,746/-, before Registry of this Court, in five monthly instalements being Rs.1 lac each for four months and remaining amount in fifth month from today. If the petitioner continues to deposit the amount as aforesaid, then there would be interim relief in terms of para 8-c till then. However, it is made clear that if the petitioner fails to deposit any monthly instalment as aforesaid, then the competent authority is free to proceed further in such recovery proceedings.

Registry shall immediately invest the said amount in fixed deposit initially for a period of six months. However, such fixed deposit is to be reinvested till final disposal of the petition.

Mr. Pandya, Ld. AGP waives service of notice for respondent no. 1.
