Perused the record and report of pendency produced by the Registry with office note dated 06.04.2015. The statement showing summary of cases pending for final hearing shows that more than 5000 cases are pending for final consideration. Therefore only because of direction under Section 17B of the Industrial Disputes Act against the petitioner, this petition cannot be listed for early hearing as requested, more particularly when it is contended by the otherside that such application is filed only because of direction in para 5 of order dated 09.12.2014 passed in Special Civil Application No.14148 of 2014, which is yet not complied with. If petitioner wants to take up the matter for final hearing, the petitioner shall either follow the order or as per their wisdom they may challenge it before the appropriate Court but hearing on early date, so as to avoid the compliance of order dated 09.12.2014 is not permissible. Hence, application is dismissed.
