Suryakanta vs State

Appropos the order dated 26.4.2007 passed by this Court, one Shri SB Garasia, Deputy Secretary, Education Department is personally present in the Court. He has also filed affidavit-in-reply. It is pointed out in the said reply that pursuant to the interim order dated 16th December 1997 passed by this Court the representation was already decided by the department some where in the year 1999 and the same was sent to the Office of the Government by communication dated 17.5.1999 for placing the said decision on the record of this Court. Shri Dipen Desai, learned AGP has submitted that the file has been misplaced and therefore the office of the Government Pleader was not aware of the said decision. Therefore he has requested to pardon and tendered apology for not producing the decision earlier. Considering the explanation given in the affidavit-in-reply the same is accepted. S.O.
