Heard Sri Alok Mishra, learned counsel for the petitioners and the learned Standing Counsel appearing for the State-respondents.

The petitioners participated in the selection for Assistant Professor pursuant to an Advertisement No. 46 of 2014. The selection was for the affiliated Degree Colleges. The petitioners were placed at Serial Nos. 2,4,5, 13 and 14 respectively in the waiting list prepared under Rule 7-A of Regulation 2014.

Learned counsel for the petitioners submits from the select list the candidates mentioned at Serial Nos. 10,22,29,42 and 46 have not joined the post and the candidates at Serial Nos. 62 and 81 under the OBC Category have also not joined. The petitioners had applied for teaching in Subject B.Ed. under OBC Category. The petitioners no. 3,4 and 5 are under General Category and petitioners no.1 and 2 are under OBC Category. In each category the aforesaid vacancies, as claimed by the petitioners, are available but their claim has not been considered so far.

The writ petition is disposed of with the direction to the Director-respondent no.2 to consider the claim of the petitioners with regard to their claim of the vacancies of relevant categories from the select list on account of non-joining of certain candidates and if there are vacancies and the petitioners are eligible, their claim be considered and appropriate orders be passed, in accordance with law, as far as possible, within a period of one month from the date a certified copy of this order is presented before the authority concerned.
