In the result, the appeal is partly allowed. The impugned judgment and order dated 01.02.2011, passed by the Additional Sessions Judge & Presiding Officer, Fast Track Court No.3, Camp at: Visnagar, is modified to the extent that the conviction u/s.304part­II of the IPC is altered to one u/s. 304 part­1 of the IPC and the accused is ordered to undergo imprisonment for ten years. However, other sentences are not changed. The sentence will remain the same. The accused shall be given the benefit of set off in accordance with law at the appropriate time.
