L.G. Chaudhary Engineers and Contractors [ 2012 (3) SCC 495], it urged that the reference is not maintainable. The challenge is on the ground placed as a contention before this Court that the said decision is per incuriam.

2. When the matter came up for consideration, learned Assistant Government Pleader Shri Tirthraj Pandya seeks permission to withdraw the present petition.

3. Permission, as sought for, is granted. This petition stands disposed of as withdrawn. However, in case of genuine ground, liberty to revive is reserved.
