The instant writ petition has been filed with a prayer that a mandamus be issued to the Tehsildar Meja, District - Allahabad to implement his order dated 22.2.2018 in Mutation Case No. 825/525 of 2018 under Section 34/35 of the U.P. Land Revenue Act, 1901.

Brief facts of the case are that in a mutation case filed under Section 34 of the U.P. Land Revenue Act, a certain order was passed 12.8.2008 which was in favour of the predecessor-in-interest of the petitioners. On 26.8.2008, however, the respondent No. 4 had moved an application for recalling the order dated 12.8.2008. On 26.8.2008, on the basis of allegations made in the application, the order dated 12.8.2008 was recalled. Consequently, the petitioners moved a Revision being Revision No. 46/107 of 2008-09 which was allowed on 25.2.2011. The matter was remanded back to the Tehsildar for of a fresh decision. It is the allegation of the petitioners that on 22.2.2018 the Tehsildar once again passed an order which was similar to the order which he had passed on 12.8.2008. This order dated 22.2.2018 was signed by the Tehsildar, the Peshkar of the Tahsildar had handed over a photostat copy of the order to the petitioner and that is how he had come to know about the order dated 22.2.2018. However, it has been stated by the petitioners that the respondent no. 4 after sometime entered the chamber of the Tehsildar and forcibly took away the record of the case and also the original order dated 22.2.2018. Thereafter, a First Information Report was lodged by the Peshkar of the Tehsildar on 23.2.2018 against the counsel Sri Dilip Kumar Shukla and Sri Kushal Chand Tiwari. Since the order which was passed in favour of the petitioner dated 22.2.2018 was torn, it has been alleged by the petitioner that he also filed a complaint before the police on 23.2.2018.

Written submissions were filed by counsel for both sides.

The petitioners' counsel therefore states that once an order had been passed by the Tehsildar and the xerox copy of which had been passed on to the petitioners, it shall be deemed that there was an order of the Tehsildar which had been passed and even if the respondent No. 4 and his counsel had taken away the order it may not mean that the order had become non-existent.

The learned counsel for the respondent No. 4, however, stated that the petitioners and the respondent No. 4 were different families and only fraudulently the petitioners had tried to get into the pedigree of the respondent No. 4 and had tried to grab the property which could never have been inherited by the petitioners. The counsel for the respondent No. 4 has tried to illustrate that, in fact, the predecessor-in-interest of the petitioners, namely, Rama Shankar was not the son of Dev Narayan but was the son of one Thakur Prasad and had nothing to do with the family of respondent No. 4. Learned counsel for the respondent No. 4 stated that after the death of Rama Sankar when the petitioners were trying to get their names substituted the respondent No. 4 had objected, and in fact, on 29.1.2013 an order was passed in favour of the respondent No. 4. The Revision filed by the petitioners was also dismissed by the Additional Commissioner, Allahabad, on 15.4.2015. It has, thereafter, been stated that when the case was listed on 20.2.2018 before the Tehsildar who allegedly passed the order dated 22.2.2018 then an adjournment application was moved on behalf of the respondent No. 4 and he had also filed a Transfer Application before the Sub Divisional Magistrate, Meja, under Section 212 of the U.P. Revenue Code, 2006, and on 20.2.2018, the Sub Divisional Magistrate, Meja, had issued notices in the Transfer Application and fixed it for 7.3.2018. By the order 20.2.2018, the Sub Divisional Magistrate, Meja, Allahabad, had also called for the record of the case. The adjournment application which was moved by the respondent No. 4 through his counsel Sri Dilip Kumar Mishra was also opposed by the counsel for the petitioners. However, on the application of the respondent No. 4 on 20.2.2018 a date was fixed for 22.2.2018. The respondent No. 4 tried to get the order dated 20.2.2018, by which date was fixed for 22.2.2018, recalled by means of an application dated 21.2.2018. This application was ordered to be put up on the date fixed i.e. on 22.2.2018. The learned counsel for the respondent no. 4 further submitted that because of the death of the wife of one Narendra Kumar Sharma, Advocate, the advocates had also decided to refrain from judicial work and he states that on 22.02.2018 there was no work done in the court of the Tehsildar. The learned counsel further submitted that as per the orders of the Government, the Tehsildar was also required to do Jan Sunwai till 12:00 noon.

Learned counsel, therefore, submits that for two very palpable reasons there was no possibility of any order being passed on 22.2.2018.

i. The Sub Divisional Magistrate, on 20.2.2018, on the Transfer Application had called for the records and had fixed 7 March, 2018, as the date in the transfer application

ii. Because of the resolution of the Bar Association, it was not possible for the court to sit and hear the case .

When the case was being heard here in the High Court a report was called from the relevant Tehsildar, who on 5.4.2018 sent a written instruction to the learned Standing Counsel which is being reproduced here as under :-

The Court on 9.4.2018 looked at the allegations made on the Tehsildar by the counsel for the respondent No. 4 and posted the matter for 20th April, 2018. On 20th April, 2018, the following order was passed by this Court:-

“Shri B.K. Rai presently posted as Tehsildar, Phoolpur is present in the Court.

Today detailed counter affidavit has been filed on behalf of fourth respondent, which is taken on record. While filing the counter affidavit serious allegations have been levelled against Shri B.K. Rai, Tehsildar, who was then holding the post in question at the relevant point of time. It is apprised that now he has been transferred and at present is posted as Tehsildar, Phoolpur.

Shri B.K. Rai, Tehsildar will also be at liberty to file his personal response to the allegations levelled in the counter affidavit filed on behalf of fourth respondent.

Let the District Magistrate, Allahabad hold preliminary enquiry regarding the allegations so levelled against Shri B.K. Rai, Tehsildar and in case he finds substance in the allegations, he may direct for proper department enquiry in the matter against the officer concerned. He will submit a report in this regard to this Court through learned Standing Counsel by the next date fixed.

Put up this matter on 10.05.2018.

Learned counsel for fourth respondent is directed to serve a copy of the counter affidavit filed today to learned Standing Counsel forthwith.

The officer concerned is exempted from appearance.

Let a copy of this order be given free of cost to learned Standing Counsel to be sent to the District Magistrate, Allahabad for necessary compliance.”

Thereafter, the District Magistrate entered into an inquiry and submitted the same before the High Court by a communication dated 23rd January, 2019. The inquiry report of the District Magistrate is being reproduced here as under:-

If the findings on Charge No. 1 are perused it appears that the Inquiry Officer had tried to inquire as to whether the Tehsildar Sri B.K. Rai had in fact passed any order on 22.2.2018, especially when there was a resolution of the Bar Association to abstain from the work and when on 20.2.2018 a Transfer Application had also been moved. The Inquiry Officer has exonerated Sri B.K. Rai from the charges but it is not clear as to what efforts were made by the District Magistrate or the Tehsildar to restore the order. The other allegations appear to be with regard to mutations made viz-a- viz some other land. However, the inquiry report does not clarify as to whether the order was in fact passed on 22.2.2018. The Tehsildar definitely says that he had passed the order. If that is the case then the District Magistrate should have tried to get the order restored. It is not conceivable that the administration should complacently sit over the issue when in fact it was stated by the Tehsildar that an order was passed. It appears strange that the District Magistrate very complacently sat over the matter. It also appears strange that the District Magistrate accepted the version of the Tehsildar that despite the resolution of the Bar Association and despite the order dated 20.2.2018 passed by the Sub Divisional Magistrate on the transfer application orders were passed by the Tehsildar on 22.2.2018. The manner in which the inquiry was held and the conclusion was arrived at is not at all to the satisfaction of the court. From the above narration of facts the following things become very clear.

i. When on 20.2.2018 the counsel for the respondent No. 4 had asked for an adjournment and when this adjournment was accepted then when exactly was the case heard. The adjournment application is at page 152 of the counter affidavit of the respondent No. 4. On the adjournment application the counsel for the petitioners had stated that the written argument be taken but there is no order for accepting the written argument.

ii. From the Application of the respondent No. 4 it appears that on 20.2.2018 the next date was fixed for 22.2.2018 for orders and the counsel for the respondent No. 4 had prayed that the order dated 20.2.2018 by which the case has been fixed for orders for 22.2.2018 be recalled. This application was ordered to be listed along with the record on 21.2.2018 itself by the Tehsildar (page 155 of the counter affidavit).

iii. On page 157 when on 22.2.2018 there was a resolution of the Bar Association that no judicial work had to take place then how could orders be passed in the case.

iv. Further when the attendance register shows that Sri Satish Chand Shukla, the Peshkar of the Tehsildar was absent on 22.2.2018 then how he could have been a witness of the happenings of 22.2.2018. It appears that the Inquiry Officer had accepted the version of the Tehsildar and had exonerated him of the Charge no. 1. No effort has been made by the District Magistrate to ascertain as to what exactly happened on 22.02.2018.

Mutation cases are a litigation, where no finality is attached and parties could have been relegated to filing of regular suits for the declaration of their rights. But in the instant case the Court is faced with a strange situation. It has been alleged by the petitioner that a judicial order dated 22.2.2018 has been removed from the file of the Tehsildar and has been torn away by the respondent No. 4. The respondent No.4 states that in fact no order could have been passed on that date. The District Magistrate has believed the version of the Tehsildar without examining the allegations made by the petitioner and the respondent No. 4. If this state of affairs is allowed to continue then matters would go from bad to worse and this would embolden anti social elements to do whatever they wish to do.

The Court under such circumstances feels it appropriate to direct that an extreme vigil be maintained in the Court premises so that in future such incidents do not occur. If ever officials feel that there would be an unruly incident whereby there would be a possibility of orders being torn or files being destroyed then they should ask for police help.

However, since it is not conclusively proved that a judgement was passed on 20.2.2018 and it is not physically possible to restore a judgement which has been alleged to have been torn away and also as the enquiry conducted by the various Administrative Authorities is not to the satisfaction of the Court, it is being directed that the Tehsildar (who shall be different from the one who had passed the earlier alleged order) shall hear the matter afresh and decide the case within a period of two weeks of the production of a certified copy of this order.

The writ petition is disposed of.
