(PER : HONOURABLE THE CHIEF JUSTICE MR. VIKRAM NATH) [1] We have heard Shri Maharashi Patel, learned counsel for H.L.Patel Advocates for the appellant, Shri Harsh K.Raval, learned counsel for the private respondent and Shri J.K.Shah, learned Assistant Government Pleader for the respondent - State.

[2] The appeal is disposed of with partial modification of the order of learned Single Judge to the extent that the rate of interest at 12% will be awarded, if the payment is not released within a period of four weeks, shall stand substituted to the extent that if the amount is not paid within four weeks', the Page 1 of 2 Downloaded on : Wed Jan 15 20:39:53 IST 2020 C/LPA/74/2020 ORDER respondent would be liable to pay the cost of the petition, which we quantify at Rs.41,000/- to be paid by the appellant within three weeks' from today. In case the amount is not paid, the above relief granted to the appellant Municipality would stand withdrawn.

[3] The amount will be paid in the account of 41 writ petitioners, by way of crediting the amount in their accounts or by way of account payee bank drafts / pay order of Rs.1,000/- each.
