HONOURABLE MS. JUSTICE R.M.DOSHIT) Learned advocate Ms. Sheth has appeared for the appellant. She states that the matter has been amicably settled out of the Court. The appellant, therefore, does not want to pursue the matter. She has filed purshis seeking permission to withdraw this Appeal and release of the vessel from the warrant of arrest issued on 3rd October 2009. Ms. Sheth also states that the appellant does not wish to pursue the suit either.
She has filed purshis in Admiralty Suit No. 14 of 2009 for permission to withdraw the suit unconditionally and for refund of the court fees.
Leave is granted. Appeal and the Civil Applications are disposed of as withdrawn. The order of arrest of the respondent-Vessel is discharged.
Registry will send copy of this order to the Port Officer at Haldia, West Bengal and the Commissioner of Customs, Haldia, West Bengal. A copy will also be sent by FAX message at the cost of the appellant.
The Port Officer, Haldia, West Bengal and the Commissioner of Customs, Haldia, West Bengal will act upon the FAX message, subject to any other order of arrest issued against the respondent-Vessel.
