Sachinbhai Shrilalbhai Pandey vs The District Collector

1. This Court has heard learned advocate Mr. U.T. Mishra for the petitioner and learned Assistant Government Pleader Mr. Bharat Vyas for the respondent no.1.

2. The petitioner is before this Court with the following reliefs:

"(A) That Your Lordships be pleased to issue an order, direction and / or writ in the nature of mandamus and / or any other appropriate writ, order or direction, directing the District Collector, Ahmedabad to immediately execute the Recovery Certificate dated 11.05.2018 issued by the Labour Court­cum­Payment of Wages Authority and same may be deposited in the Labour Court, Ahmedabad;

(B) That Your Lordships be pleased to direct the Labour Court to immediately disburse the amount in favour of the petitioner after proper verification."

Notice for final disposal. For respondent no.1 learned Assistant Government Pleader Mr. Bharat Vyas appears. However, though served duly, the respondent no.2 is chosen not to appear before this Court.

4. According to the learned Assistant Government Pleader, four times notices have been issued to the respondent no.2 on 26.06.2018, 08.08.2018, 17.09.2018 and last one was on 06.01.2020. He has urged before this Court that recovery is likely to occur on 17.01.2020.

5. Considering the period of nearly two years from the time, recovery certificate has been issued by the Labour Court­cum­Payment of Wages Authority dated 11.05.2018, let the process be expedited and report shall be furnished to this Court. Other and further order, if any, shall be passed on 20th January, 2020.

Let the matter appear on 20th January, 2020.
