The applicant herein - original accused has preferred this Criminal Revision Application under Section 397 read with Section 401 of the Code of Criminal Procedure, 1973, against the judgment and order dated 22nd March 2016 passed by the Principal Sessions Judge, Kheda at Nadiad, in Criminal Appeal No.09 of 2014, by which the said Court has confirmed the judgment and order dated 4th January 2014 passed by the Additional Judicial Magistrate, First Class, Kapadwanj, District Kheda, in Criminal Case No.1811 of 2008.

The learned advocate for the applicant has drawn Page 1 of 2 HC-NIC Page 3 of 4 Created On Tue May 03 02:20:33 IST 2016 3 of 4 R/CR.RA/315/2016 ORDER the attention of this Court on Exh.29, page 74, and states that the impugned order had been stayed by the Court and the conviction has been suspended upto 30th April 2016. As such, within the stipulated time, the present applicant has preferred the appeal. He further states that the applicant herein is ready to deposit initially Rs.1 lac on or before 7th June 2016. He requests to extend the said suspension period upto 7th June 2016.

Under the circumstances, notice be issued against the respondents, returnable on 8th June 2016. Mr.Pandya, the learned APP, waives service of notice for and on behalf of the respondent no.1 - State.
