Heard Sri Digvijay Singh, learned counsel for the petitioner and learned Standing Counsel for the State respondents and have perused the record.
None has appeared on behalf of respondent nos. 2 and 3, though copy has been served to him and there is endorsement of receipt in the memo of writ petition by Sri Pradeep Chauhan.
By means of present writ petition, the petitioner has prayed for a writ in the nature of mandamus directing respondent no. 3, Municipal Commissioner, Moradabad to consider and decide the representation of the petitioner dated 03.04.2019.
Learned Standing Counsel does not have objection if direction for disposal of the application of the petitioner has been given on its own merit within stipulated period of time.
Without entering into the merits of the case and considering the submission advanced by the learned counsel for the parties, we are disposing of this writ petition with direction to the Municipal Commissioner, Moradabad, namely, 3rd respondent to consider the application of the petitioner dated 3rd April, 2019 in accordance with law and decide the same by reasoned and speaking order within period of six weeks' from the date of production of certified copy of this order.
