1. This application has been filed with a prayer to restore Miscellaneous Civil Application(Stamp) No. 1845 of 2009 in Special Civil Application No.1825 of 2009 to the file and to condone the delay of 46 days that has occasioned in filing the present application.

2. Mr.

Sunil Mehta, learned Advocate for Mr. S.K. Bukhari, learned Counsel for the applicant, has submitted that appearance in Miscellaneous Civil Application (Stamp) No.1845 of 2009 was filed on 28.01.2009, and the matter was dismissed for non-removal of office objections on 03.11.2009.

3. Earlier, another learned Counsel was appearing for the applicant and, therefore, there was some misunderstanding, due to which the office objections could not be removed in time.

4. Mr.

Mehta, learned Advocate for the applicant undertakes to remove the office objections on, or before 9th February, 2010.

5. In view of the submissions made at the bar and the averments contained in the application, the interest of justice of would be met if the prayers made there are allowed.

6. Accordingly, the application is allowed. The delay of 46 days is condoned. On removal of the office objections on, or before 9th February, 2010, Miscellaneous Civil Application (Stamp) No. 1845 of 2009 in Special Civil Application No.1825 of 2009, shall be restored to its original position on file.
