The present writ petition has been filed praying for a writ of certiorari to quash the entire proceedings of Reference No. 89 of 2016-17 pending before the Deputy Director of Consolidation, Ghazipur on the ground that the same was not maintainable as the reference proceedings were instituted after the notification issued under Section 52 of the Uttar Pradesh Consolidation of Holdings Act, 1953 (hereinafter referred to as, 'Act, 1953').

The Deputy Director of Consolidation, Ghazipur while deciding the aforesaid reference shall also decide the maintainability of the reference under Section 48(3) of the Act, 1953. In view of the aforesaid, no certiorari as prayed by the petitioner is required to be issued.

With the aforesaid observations, the writ petition is disposed of.
