Ram Prabhudayal Yadav vs State Of Gujarat

1. The petitioner has prayed to direct the respondents to declare that the petitioner is entitled to be appointed to the armed division of constabulary of District Kutch and to have his seniority reckoned from the year 1996 in armed division.

2. It may be pointed out that initially the petitioner who was working as armed constable aspired to go to the unarmed constabulary. With that aim in mind, he approached this Court with other 19 persons, by filing Special Civil Application No. 17651 of 2016 with Special Civil Application No. 1542 of 2017 with a prayer that he should be considered as being entitled to be appointed to the unarmed division of constabulary. It was also prayed that his services may be reckoned for the purposes of seniority in the unarmed division. It appears that pursuant to the directions issued by this Court in the aforesaid petition on 29.11.2018 to consider Page 1 of 2 Downloaded on : Mon Jan 13 21:02:25 IST 2020 C/SCA/3064/2019 ORDER the case of the petitioner for being offered posting in unarmed constabulary in Kutch district, the case of the petitioner was considered and he was posted in unarmed constabulary.

3. Mr. Rohit Patel, learned advocate for the petitioner draws my attention to page 11 of the petition and states that now the petitioner has changed his mind and he does not want to be continued to be posted in the cadre of unarmed constable in Kutch district. He has accordingly made a representation on 19.12.2018.

4. In the event it is thought fit, the respondents may consider the petitioner's representation dated 19.12.2018 to repost him to the post of armed constable. Such representation shall be considered preferably within six weeks from the date of receipt of the writ of the order of this Court. Petition is disposed of accordingly. Direct service is permitted.
