Prayer made in the instant petition is for directing the trial court to decide application 22-C2 under Order 7 Rule 11 CPC filed by the defendant-petitioner in Original Suit No.350 of 2007 within a stipulated period.

A perusal or order sheet reveals that the trial court, after filing of the said application invited objections against the same from the plaintiff-respondents. The plaintiff-respondents have already filed objection against the said application.

The court has also fixed date for disposal of application under Order 7 Rule 11 CPC but the same could not be disposed of as the Presiding Officer is reported to have gone on training.

Having regard to the entire facts of the case, the instant petition is disposed of with direction to the trial court to ensure expeditious disposal of application under Order 7 Rule 11 CPC by fixing short dates and without granting unnecessary adjournments to the parties.
