[1] Heard Ms. Bhakti Joshi, learned advocate for the applicant and Ms. Maithili Mehta, learned Additional Public Prosecutor for the respondent - State through Video Conferencing.
[2] The present application has been filed by applicant on temporary bail on the ground of reconstruct the house of the applicant as it is damaged/ collapsed and it is difficult for his three minor to live peacefully.
[3] I have heard Ms. Bhakti Joshi, learned advocate for the applicant and learned Additional Public Prosecutor for the respondentState as well as considered the averments made in this application.
the case, I am of the opinion that the application requires consideration and the same is partly allowed. The applicant shall be released on temporary bail for a period of 30 days from the date of his actual release, on executing personal bond of Rs.10,000/ (Rupees Ten thousands) before the Jail authority and on usual terms and conditions. The applicant shall mark his presence once in a week before the concerned police station between 9.00 a.m to 4 p.m. The applicant shall surrender to the Jail Authority after completion of temporary release, without fail. During the period of temporary bail, the convict shall not abuse the liberty granted to him and shall maintain law and order. Rule is made absolute to the aforesaid extent.
[5] On completion of such period, when the applicant surrenders, he shall be tested for COVID19 virus test by the jail authorities and till the report comes, he will be kept in seclusion and/ or at a quarantine place.
[6] Registry is directed to intimate about this order to the concerned authorities through fax, email and/or any other suitable electronic mode.
