Raj Kumar Nagar Advocate vs State Of U P And Others

High Court Of Judicature at Allahabad|06 November, 2017
Court No. - 29
Case :- WRIT - C No. - 51147 of 2017 Petitioner :- Raj Kumar Nagar Advocate Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Manoj Kumar Srivastava Counsel for Respondent :- C.S.C.
Hon'ble Tarun Agarwala,J. Hon'ble Ajay Bhanot,J.
Having heard the learned counsel for the petitioner, we are of the opinion that the writ of mandamus cannot be issued straightaway to an authority. First and foremost principle is that the petitioner should approach the authority and in the event, the respondent-authority does not pass any order, the petitioner can approach the writ court for issuing a writ of mandamus.
In the instant case, the petitioner did not approach the Assistant Registrar and therefore, no mandamus can be issued.
Dismissed with the aforesaid observation.
Order Date :- 6.11.2017 Ashish Tripathi (Ajay Bhanot, J.) (Tarun Agarwala, J.)
