Prabatji Vahtaji Bhagaliya vs State Of Gujarat

[1.0] By way of present petition under Articles 14 and 226 of the Constitution of India, following prayers have been made.

"(B) YOUR LORDSHIP be pleased to direct the respondent authorities to immediately remove the illegal encroachment done by respondent No.6, on Government Gauchar land bearing Survey No.437 situated in Chandisar, and that too, within the time limit bounded by this Court; as well as, further be pleased to direct the respondent no. 2 to pass the appropriate order on merits, in application dated 27­3­2017 at the earliest, in the interest of justice;"

[2.0] Having heard Ms. Amita Shah, learned advocate appearing for the petitioner and learned AGP appearing for the respondent - State of Gujarat, I am of the opinion that following order would meet the ends of justice.

C/SCA/13482/2018 ORDER The District Collector, Banaskantha is hereby directed to look into the representation dated 27.03.2017 made by the petitioner about the alleged illegal encroachment upon the Gauchar land and shall take immediate steps in accordance with law and shall also examine the directions issued by the Appeal Committee, Deputy District Development Officer (Panchayat), Palanpur, District Banaskantha.

[3.0] With above directions, present petition is disposed of. It is hereby made clear that this Court has not gone into the merits of the case. Direct service is permitted.
