Learned advocate Mr. Prabhakar Upashyay wants to argue the matter for admission though there is withdrawal of similar petition on 10.12.2014 being Special Civil Application No. 118 of 2014. It seems that copy of order dated 13.06.2007 as part of annexure B is improper, in as much as, few words are missing on page 25. During arguments learned advocate has referred annexure B, however it would be necessary to know that while passing such order, whether competent authority has heard the employee being respondent No.3 herein and that whether respondent No.3 has been given any opportunity or not. Learned advocate for the petitioner is not certain about discloser of such facts on record.
