Rule. Ms. Moxa Thakkar, learned Additional Public Prosecutor waives service of notice of Rule on behalf of the respondent State. In the facts and circumstances of the case, present application is taken up for final hearing.
2.0. Present application has been preferred by the applicant to release him on temporary bail for the medical treatment of his and / or for post operative treatment of his wife.
3.0. Ms. Moxa Thakkar, learned Additional Public Prosecutor has stated that factum of operation of wife of the applicant is confirmed. It appears that from the report submitted by the learned Additional Public Prosecutor which is directed to be taken on record that the wife of the applicant has been operated on 22.4.2016, however thereafter she has been discharged from the hospital on 24.4.2016. Under the circumstances, for post operative medical treatment, present application is partly allowed. The applicant is ordered to be released on temporary bail for a period of 7 days from 05.05.2016 on his furnishing personal bond of Rs.10,000/ to the satisfaction of the jail authority and on usual terms and conditions and on further condition that applicant shall surrender to the concerned jail authority on 13.5.2016 before 11 a.m. without fail. Shri Shukla, learned advocate for the applicant has stated at the bar that applicant shall be satisfied with the present order and shall not ask for any extension. Rule is made absolute to the aforesaid extent. Direct service is permitted.
