Learned advocate appearing on behalf of the petitioners seeks permission to withdraw the present petition with a observation that since the newly added defendant(s) have belatedly approached the trial Court in order to establish the dilatory practice in stalling the entire proceedings, therefore, direction may be issued to the learned trial Court to expedite the trial and hearing after affording reasonable opportunity to all the parties concerned.

Permission, as prayed for, is granted. The present petition stands disposed of as withdrawn.

The learned trial Court is directed to expedite the trial and hearing in accordance with law and newly added party shall file the written statement and documentary evidence or any evidence forthwith. The plaintiff shall be at liberty to carry out the amendment, if any, within a reasonable period and in view of the new added impleadment of respondents, issues may be re-casted accordingly.
