Supplementary counter affidavit filed on behalf of opposite party no.3 in the connected Application U/s 482 No.22187 of 2017, is taken on record.

Heard learned counsel for the parties.

Perusal of the supplementary counter affidavit indicates that parties have reached workable compromise. Under paragraph no.5 of the affidavit, it has been averred that the applicant Om Prakash Sonik one of the accused has expired on 07.07.2016.

In view of above, the instant application has lost its efficacy and proceedings cannot be allowed to go on.

Accordingly, the instant application is dismissed as infructuous.
