(Per : HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA) The counsel for the respondent is allowed three weeks' time to file reply affidavit and state (i) the distance between the two schools; (ii) whether the students of the school of the respondent - writ petitioner took admission in the appellant school after opening of the appellant - school; and (iii) why the writ petition was preferred after seven years of delay from opening of the appellant school. These are the three questions on which the appeal may be disposed of on the next date.

Post the matter on 22nd June, 2010 within five cases in the first board.

Until further orders, the operation of the order dated 15.2.2010 passed by the learned Single Judge in Special Civil Application No. 11681 of 2007 shall remain stayed. Civil Application No. 4794 of 2010 stands disposed of.

Direct Service is permitted.
