1. The present application has been filed by the applicant-under trial accused to release him on temporary bail on the ground that he has to appear in the written as well as practical examinations, which are scheduled to be held between 20th May 2016 and 5th June 2016. In support of this application, necessary documents are produced on record.

2. I have heard learned advocate for the applicant and learned Additional Public Prosecutor for the respondent-State as well as considered the averments made in this application.

Considering the aforesaid facts and circumstances of the case, as Page 1 of 2 HC-NIC Page 1 of 2 Created On Wed May 04 05:14:47 IST 2016 R/CR.MA/9928/2016 ORDER also the verification report of the Deputy Superintendent of Police, Jamnagar, this Court is of the opinion that this application requires consideration, and the same is partly allowed. The under-trial prisoner - shall be released on temporary bail from 4th May 2016 to 6th June 2016, on executing personal bond and local surety in the sum of Rs.5,000/- (Rupees Five Thousand only) before the Jail authority, and on usual terms and conditions. The applicant shall mark his presence twice before the concerned police station between 9.00 a.m to 4 p.m. during his temporary bail period when no examinations are held. The under trial prisoner shall surrender to the Jail Authority after completion of temporary release, without fail. During the period of temporary bail, the convict shall not abuse the liberty granted to him and shall maintain law and order. The applicant shall not ask for any further extension. Rule is made absolute to the aforesaid extent. Direct service today is permitted.
