Marutinandan Kathiawadi vs State Of Gujarat &

1. Mr. R.S. Sanjanwala, learned Senior Advocate assisted by Mr. C.B. Upadhyaya, learned advocate appearing for the petitioner, on instructions, states that in pursuance of notice dated 14.3.2016 which is issued by the Ahmedabad Municipal Corporation, which is under challenge, the petitioner shall appear before the concerned Officer and shall file detailed reply including raising the issue that the case of the petitioner is different than the case of other occupiers which are covered under the order dated 10.12.2015 passed by the coordinate Bench of this Court in Special Civil Application No.18136 of 2011. He would further submit that the respondents be directed to give personal hearing to the petitioner.

2. Having heard learned advocate appearing for the petitioner, the following order is passed :-

"In pursuance of the notice dated 14.3.2016, the petitioner shall file his detailed reply to the Page 1 of 2 HC-NIC Page 1 of 2 Created On Thu May 05 03:26:42 IST 2016 C/SCA/7549/2016 ORDER concerned Officer of Ahmedabad Municipal Corporation within a period of two weeks from today. The said Officer of the Corporation shall give personal hearing to the petitioner and thereafter, shall pass order in accordance with law within a period of four weeks thereafter."

3. Subject to the above direction, the present petition stands finally disposed of. Direct service is permitted.
