Lokmanya vs Gujarat

(Per : HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA) The matter relates to grant of affiliation to the petitioner college for conducting Bachelor of Business Administration (BBA) course. Petitioner college, having not been granted permission and not allotted the students to the petitioner-institute for the academic session 2010-2011, preferred an appeal under Section 38 of the Gujarat University Act, 1949 which is pending with the State. Under the circumstances, instead of deciding the case on merits, we direct the appellate authority State to decide the appeal on merits after hearing the petitioner within one month from the date of receipt / production of the copy of this order.

The writ petition stands disposed of. Direct service permitted.

Needless to say if the appeal is allowed in favour of the petitioner-institution, the University will act in terms of the said decision.
