None has appeared to press this writ petition, which is directed against an order dated 16.12.2011 passed by the Civil Judge (J.D.) Gorakhpur in Original Suit No. 1156 of 2006.

Apart from the fact that the writ petition suffers from latches of almost six years, this Court finds, that by the order impugned, a substitution in a counter claim has been allowed.

Even on its merits the order of substitution suffers from no illegality.

Under the circumstances, this Court finds that the writ petition is completely devoid of merits.

It is accordingly dismissed.
