The petitioner claims to be a co-owner of House No. S-17/258, Nadesar, Cantonment, Varanasi. He is aggrieved by the order dated 22 May 2017 passed by the Sub Divisional Officer of the Vidut Vitran Upkhand (Pratham), Varuna Pul, Varanasi, by which the request made by the petitioner for grant of electricity connection has been refused on the ground that the petitioner has not been able to furnish proof of ownership of the house.
Learned counsel for the petitioner has placed reliance upon a Division Bench judgment of this Court in Seema Mansoor v.
U.P. Power Corporation Ltd., Lucknow and Others reported in 2014(6) ADJ 672 to contend that an occupier has also a right to get an electricity connection on the premises.
Sri Mahboob Ahmad, learned counsel appearing for the respondents sates that in case the petitioner files a fresh application, the same shall be considered and decided by the Executive Engineer concerned.
The writ petition is, accordingly, disposed of with a direction that in the event the petitioner files an application before the Executive Engineer concerned for providing an electricity connection, the same shall be examined by the Executive Engineer in accordance with law expeditiously and preferably within a period of three weeks from the date of filing of the application.
