(PER : HONOURABLE MR.JUSTICE KS JHAVERI) By way of filing this Misc. Civil Application, the applicant has inter alia prayed for a direction/clarification of order dated 7.3.2014 passed by this Court in Special Civil Application No.15487 of 2008 and other cognate matters.

We have heard Mr Rasesh Sanjanwalla, learned Senior Advocate assisted by Mr Ajay Jagirdar, learned advocate for the applicant and Mr S.N. Shelat, Senior Advocate, assisted by Mr Satyam Chhaya, learned advocate for the respondents.

Mr S.N. Shelat, learned Senior Advocate stated that the amendment which was suggested for the private property is not granted and in view of the same, the appropriate remedy available for the applicant is to challenge the decision of the State Government. In that view of the matter, the present Page 1 of 2 C/MCA/890/2015 ORDER application is not maintainable and the same is dismissed. However, it will be open for the applicant to challenge the action of the State Government and the Corporation. It is clarified that we have not expressed anything on merits.

The interim arrangement which continued till today will continue till 10th April 2015.
