DAVE) In spite of the fact that Rule was discharged and the directions were given without entering into the merit of the case vide order dated 21.03.2017 passed by the learned Single Judge in Special Civil Application No.2109 of 2017, learned counsel for the applicant continued to argue repeatedly on the same point.

If the applicant is given notional promotion, it cannot be said to be a deliberate and will disobedience of the order under contempt.

C/MCA/32/2018 ORDER In view of the above and in absence of any merit, we dismiss this application with costs of Rs.10,000/­.
