1. Heard Mr. Viral V. Dave, learned advocate for the petitioners, Ms. Jyoti Bhatt, learned AGP for the respondent Nos. 1 & 3 and Mr. Dhaval G. Nanavati, learned advocate for respondent No.2.

2. Mr. Dave, learned advocate for the petitioners submits that the petitioners have made representation dated 18.10.2019 to the Chief Town Planning Officer, Gandhinagar for variation in the Town Planning Scheme. He further submits that so far as the Chief Town Planning Officer has not taken any decision on the said representation. He, therefore, urges that the Chief Town Planning Officer may be directed to decide the representation expeditiously and the petition may be disposed of.

3. The petitioners have made substantive prayer in the petition for giving direction to respondent Nos. 1 & 3 to make Page 1 of 2 Downloaded on : Thu Jan 09 02:22:49 IST 2020 C/SCA/3849/2019 ORDER variation of the road situated in the City Survey No.243 to 253 and Town Planning Scheme No.8 (Palanpore), Surat. The petitioner have also made representation dated 18.10.2019 to the Chief Town Planning Officer in that regard. Hence, the Chief Town Planning Officer is directed to decide the representation dated 18.10.2019 on or before 30th April, 2020 strictly in accordance with law under intimation to the petitioners.

4. It is made clear that this Court has not examined the merits and the Chief Town Planning Officer shall decide the representation strictly in accordance with law.

5. Notice is discharged.
