Learned senior counsel at the outset raised contention as to the locus standi of the petitioner to object the sale of the trust property in question.

Impugned in this petition is the order of Gujarat Revenue Tribunal whereby the Tribunal dismissed the appeals of the petitioner-objector in turn confirming order of the Charity Commissioner dated 09th September, 2014 in Application No.36/47/2011 by which order permission was granted by the Charity Commissioner under Section 36 of the Bombay Public Trust Act, 1950 (Now Gujarat Public Trust Act, 1950) to sell the agricultural land situated adjoining Manichandra Society, near Surdhara Circle being Final Plot No.104 paiki, 40,836 Sq. Meters on as is where is basis.

At this stage, without going into the merits and keeping the condition as to the locus of the petitioner open, in order to complete procedural formality, let there be a Notice, returnable on 23rd June, 2016. This is without prejudice to the contentions which may be available and raised by both the sides at the time of hearing including on the aspect of locus standi as above.
4. Learned advocate Mr.Sandip Singhi waives service of notice for respondent Nos.5 and 6.
